General Terms and Conditions (GTC)
1. Scope
These Terms and Conditions apply to all orders placed through our online shop. Our online shop is directed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who acts in the exercise of their trade, business, or profession when entering into a legal transaction.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with Nathalie Theo Art.
By listing products in the online shop, we make a binding offer to conclude a contract for those products. You may initially place our products in the shopping cart without obligation and may correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.
3. Contract Language, Storage of Contract Text
The language(s) available for the conclusion of the contract: German, English.
We store the contract text and send you the order data and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery Conditions
Delivery options
We ship the products to the delivery address specified during the ordering process.
We deliver by shipping only. Collection of the goods by the customer is not possible.
We do not deliver to Packstations.
5. Payment
In our shop, you generally have access to the following payment methods.
Credit card
During the ordering process, you enter your credit card details. Your card will be charged immediately after you submit the order.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, log in with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after you submit the order. Further information will be provided during the ordering process.
PayPal may offer additional payment methods in the customer account to registered PayPal customers selected according to PayPal’s own criteria. We have no influence on the offering of these methods; any additional payment methods offered individually concern your legal relationship with PayPal. Further information can be found in your PayPal account.
Warranty and Guarantees
6.1 Liability for Defects
The statutory liability for defects applies.
6.2 Guarantees and Customer Service
Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.
7. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and designated by you, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Nathalie Theodossiadis, Sülldorfer Kirchenweg 181, 22589 Hamburg, Germany, nathalietheoart@gmail.com) of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for any additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees for such reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.
You shall send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send off the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You will only be liable for any diminished value of the goods if this loss in value is due to handling them in a way that was not necessary to examine their nature, characteristics, and functioning.
